This agreement exists between the customer (“Lessee”) renting an instrument and Gottschalk Music Center (“GMC”).
A $10.00 charge will be added to every delinquent payment using a 10 day grace period. Payment must be received within 10 days of the due date or it is considered LATE. NSF (Non-Sufficient Fund) checks will receive a $25.00 administration charge. Lessee may terminate this contract at any time by returning the instrument to GMC and paying for any delinquent payments/charges. At the time of the return, the current month’s prepaid rental fee will not be prorated for refund. No refunds on accessories will be included. Lessee understands that if the rental account becomes more than 60 days past due, GMC may submit the account to collections and the Lessee will be responsible for the full purchase price of the rental instrument plus any due rental fees and late charges including all costs incurred by GMC attributed to collection.
Lessee will be liable for the cost of any repairs and agrees to have all repairs made by GMC. In the event of theft of the instrument or damage beyond reasonable repair of the instrument, Lessee will be liable and agree to pay GMC for the full “Instrument Value” (as stated on the front of this contract) of the rental instrument.
The Theft and Maintenance Coverage (TMC), if opted and paid on time, voids paragraph three (3) above, per the conditions of the TMC listed in paragraph five (5) below.
Theft and Maintenance Coverage Option: If this option is chosen by paying the TMC fee and Lessee is not in default of this Agreement, GMC will waive any liability Lessee may have to GMC with regards to repairs, damage or theft of the instrument, subject to the following:
The rental instrument that is stolen or totally destroyed by fire, occurring not through the fault and/or malicious intent of the Lessee will be covered provided the theft or destruction is reported to the proper civil authorities and a written police or fire report is made within seventy-two (72) hours of the event. GMC will require Lessee to provide a copy of this report documenting any theft or destruction.
GMC will repair and/or regulate the instrument to proper playing condition without charge. This does not apply to deterioration of appearance that does not affect the performance of the instrument, such as scratches, minor dents and imperfections in the finish. Specifically excluded from this waiver are normal user wear items such as, but not limited to: strings, rosin, bow hair, reeds, swabs, lubricants, drum heads, drum sticks, lyres, lost parts, ligatures, user-installed equipment and/or special or custom equipment.
All repair claims that are made under this TMC option must be completed by GMC. Under no circumstances may any other party or repair shop perform work on the instrument other than GMC unless prior written consent is given by GMC authorizing such work.
Except as provided in 6(a) above, under no circumstances will the TMC apply to an instrument that has been subject to damage or destruction beyond normal wear and tear; unauthorized repair attempts; and/or shipment in inadequate packaging by the Lessee or their agent. GMC shall be the sole judge in all cases.
This is a Rent Only contract and the lessee does not have the option to purchase the rental instrument. Lessee may apply all base rental fees paid up to a maximum of nine (9) months, no other fees or charges paid apply toward purchase (tax, maintenance/theft coverage and maintenance fees do not apply) of an upgraded or new instrument of “like type” (i.e., the same/different model and/or same/different manufacturer of the same instrument) as long as the value of the trade up or new instrument is equal to or higher than the rental unit.
Gottschalk Music Center’s SMS marketing solution is used by Gottschalk Music Center to educate, enjoy and maintain a musical instrument as well as to suggest other products and improve your shopping experience. By renting an instrument, you agree to receive recurring text notifications about product information, educational content, tips, tricks and requests for reviews from us. By consenting to commercial text messages in Gottschalk Music Center’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools (such as through a form or a question within a text), you agree to receive additional recurring commercial text notifications in relation to your order, including without limitation text marketing offers and transactional texts, such as product information and offers and requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase. If you do not wish to receive such text marketing messages and notifications, reply with STOP to any mobile message sent from us. We may send a text in response confirming your request to us. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. You agree that the telephone number you provided to us is yours and if your telephone number changes, you must notify us of your changed number. Your right to privacy is important to us.
